Terms and Conditions.
The terms that apply when you use chipukeezyfoundation.org, donate to CYEF, order merchandise or take part in one of our programs.
These terms are a contract between you and CYEF. They are written to be read, not to be hidden behind. Please go through them before donating, ordering or applying to take part in a program.
1Agreement to these terms
By accessing or using chipukeezyfoundation.org, submitting an enquiry, making a donation or placing a merchandise order, you agree to these Terms and Conditions and to our Privacy Policy.
If you do not agree with them, please do not use the Website. If you are agreeing on behalf of an organization, you confirm you have authority to bind that organization.
2Definitions
- "CYEF", "we", "us", "our" means Chipukeezy Youth Empowerment Foundation.
- "Website" means chipukeezyfoundation.org and any subdomain we operate.
- "You", "your" means anyone using the Website or dealing with CYEF under these terms.
- "Content" means text, images, video, audio, graphics, logos and data published on the Website.
- "Programs" means the activities CYEF runs in education, sport, creative development, health and conservation.
- "Merchandise" means physical goods CYEF offers, such as the Chipukizi FC jersey.
3Who we are
Chipukeezy Youth Empowerment Foundation is a Kenya-based youth organization founded in 2017 by Vincent Muasya Mutua, working across Machakos, Nairobi and Mombasa through programs in sport, education, media and community partnerships. Our education base is St. Martin De Porres School in Tala, Machakos County.

4Eligibility
The Website is intended for adults. You must be at least 18 or have the consent of a parent or guardian, to submit an enquiry, make a donation or place an order.
Program participation by a young person under 18 requires the consent of a parent or guardian and is subject to our safeguarding procedures.
5Permitted use of the website
You may browse the Website, read and share our content, contact us and use the forms provided, for lawful personal or organizational purposes. You may link to our pages, provided you do so fairly and without suggesting an endorsement or association that does not exist.
6Things you must not do
- Use the Website for any unlawful purpose or in breach of these terms.
- Attempt to gain unauthorized access to the Website, its server or any connected system.
- Introduce malware or otherwise interfere with the operation or security of the Website.
- Scrape, harvest or systematically extract content or contact details, including for marketing.
- Use our name, logo or content to solicit money or personal information from anyone.
- Impersonate CYEF, our staff or our partners.
- Submit anything false, abusive, obscene, defamatory or harmful to a child.
- Attempt to identify or contact a young person featured on the Website.
We take attempts to misuse imagery of children or to impersonate the foundation extremely seriously and will report them to the relevant authorities.
7Enquiries and submissions
Forms on the Website prepare an email enquiry. Submitting one starts a conversation, it does not create a binding agreement, guarantee a program place, confirm an order or commit CYEF to a partnership.
You confirm that the information you give us is accurate and that you are entitled to share it. If you send us information about someone else, such as a child, you confirm you have the authority to do so.
If you send us an idea, photograph, story or other material, you grant CYEF a non-exclusive, royalty-free license to use it in connection with our work, unless we agree otherwise in writing. You keep ownership of what you send.
8Intellectual property
The CYEF name, the Chipukizi FC name, our logos, photography, video, program descriptions and other Content on this Website are the property of CYEF or are used with permission and are protected by applicable copyright and trademark law.
You may view, download and print pages for your own non-commercial use. You may quote short extracts with clear attribution and a link. You may not reproduce our Content commercially, present it as your own, use our marks without written permission or use images of participants for any purpose of your own.
If you believe something on the Website infringes your rights, contact us and we will investigate promptly.
9Donations
- Donations support CYEF's charitable work. Unless a gift is expressly restricted to a named program and accepted by us on that basis, we allocate funds where the need is greatest.
- Where a restricted purpose becomes impractical, we will contact you to agree an alternative use.
- Donations are made voluntarily and are not a purchase of goods or services and confer no ownership, membership or control over CYEF.
- We issue an acknowledgement for donations. Tax treatment depends on your own circumstances and jurisdiction and you should take your own advice on deductibility.
- We reserve the right to decline or return a donation, including where accepting it would conflict with our values or expose the foundation to reputational or legal risk.
10Payments and providers
Online card and M-Pesa STK Push payments are offered through a third-party payment provider. When they are active, that provider's own terms and privacy policy apply to the transaction alongside these terms.
CYEF does not receive or store full card numbers, CVV codes or M-Pesa PINs. Prices and donations are in Kenya Shillings (KES) unless stated otherwise and your bank or provider may apply its own conversion or transaction fees.
Where online checkout is offline, giving instructions are confirmed directly by CYEF through the official channels in section 12.
11Refunds and cancellations
- Donations are generally non-refundable, because they are put to work quickly. If you donated in error, made a duplicate payment or entered the wrong amount, contact us within 30 days and we will review it sympathetically.
- Recurring donations can be cancelled at any time by emailing us. Cancellation stops future payments, it does not reverse payments already taken.
- Merchandise is covered by section 16.
- Where a refund is agreed, we make it by the original payment method, normally within 14 days of agreeing it.
12Fraud and official channels
CYEF will never ask you to send money to a personal M-Pesa number or a personal bank account. Official giving and order instructions come only from info@chipukeezyfoundation.org, from +254 748 390 908 or from a page on chipukeezyfoundation.org.
If you receive a message, invoice or social media account claiming to represent CYEF and something looks wrong, do not pay. Contact us first and we will confirm whether it is genuine. We are not liable for payments made to accounts we do not control, but we do want to know about them so we can act.
13Merchandise orders
Merchandise enquiries submitted through the Website are an invitation to treat, not a completed sale. A contract is formed only when CYEF confirms your order in writing and payment is received.
We confirm size, quantity, price, payment method and delivery or collection arrangements before an order is treated as final. Bulk and team orders are handled by written confirmation and lead times differ.
14Pricing and availability
The official Chipukizi FC 2025 jersey is priced at KES 3,000. Prices are inclusive of any applicable taxes unless stated otherwise and exclude delivery unless we say so.
Merchandise is subject to availability and stock is limited by size. If an item becomes unavailable after you order, we will offer an alternative, a wait or a full refund. If a price is listed in obvious error, we are not obliged to honor it. We will contact you before proceeding.
15Delivery and collection
- Delivery and collection arrangements are confirmed with you before payment.
- Delivery timelines are estimates. We are not liable for delays caused by couriers, weather or other events outside our control.
- Risk in the goods passes to you on delivery or collection. Ownership passes once payment has cleared in full.
- Please check your order on receipt and tell us within 7 days if anything is missing, incorrect or damaged in transit.
16Returns, exchanges and faulty goods
- Exchanges. Unworn, unwashed merchandise in its original condition may be exchanged for a different size within 14 days of receipt, subject to availability. You cover the cost of returning it.
- Faulty or misdescribed goods. If an item is faulty, damaged on arrival or not what was described, tell us within 7 days. We will repair, replace or refund it and cover the return cost. This does not affect your statutory rights under the Consumer Protection Act, 2012.
- Customized items such as a jersey printed with a specific name or number cannot be exchanged unless faulty.
- Proof of purchase is required for any return or exchange.
17Programs and volunteering
Information about programs is provided so you can understand our work. It is not an offer of a place.
- Enquiring about a program does not guarantee selection, enrolment, sponsorship or a volunteering role.
- Places are limited and are allocated according to need, suitability and available capacity.
- Volunteers and partners may be asked to complete checks, provide references and accept our safeguarding requirements before working with young people.
- We may end participation where conduct puts a child, another participant or a staff member at risk.
18Safeguarding
CYEF works with children and vulnerable young people. Anyone interacting with the foundation, including visitors, volunteers, partners and media, is expected to respect the dignity, safety, consent and privacy of every young person at all times.
Website enquiries do not create unsupervised access to any learner or participant. Concerns must be raised through the official channels on our Safeguarding page and we will act on them.
19Accuracy and no professional advice
We take care to keep the Website accurate and current, but figures, program details and campaign information change. We do not warrant that everything is complete or error-free at all times.
Nothing on the Website is legal, financial, medical or educational advice. It should not be relied on as a substitute for advice from a qualified professional.
20Availability of the website
We aim to keep the Website available, but we do not guarantee uninterrupted access. We may suspend, withdraw or change all or part of it for maintenance, security or operational reasons, normally without notice and without liability to you.
21Third-party links and partners
The Website links to partner organizations, social media accounts and other third-party sites. Those links are provided for information. We do not control that content, we do not endorse it by linking to it and we are not responsible for it. Naming a partner does not mean that partner endorses everything on this Website.
22Privacy
Our handling of personal information is set out in the Privacy Policy, which forms part of these terms. Cookie choices can be changed at any time: .
23Disclaimers
The Website and its Content are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, conditions and representations that are not expressly set out in these terms, whether implied by statute, common law or otherwise.
We do not warrant that the Website will be free of viruses or other harmful components and you are responsible for your own device security.
24Limitation of liability
To the fullest extent permitted by Kenyan law, CYEF, its trustees, staff and volunteers are not liable for indirect, incidental, special or consequential loss arising from your use of the Website or from reliance on its Content. That includes loss of profit, revenue, data, goodwill or anticipated savings.
Where we are found liable in connection with a merchandise order, our total liability is limited to the amount you paid for that order.
Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation or for any other liability that cannot lawfully be excluded.
25Indemnity
You agree to indemnify CYEF against reasonable claims, losses and costs arising from your misuse of the Website, your breach of these terms or your infringement of the rights of a third party.
26Events outside our control
We are not liable for failure or delay in meeting our obligations where it is caused by something beyond our reasonable control, including power or network failure, courier disruption, industrial action, civil unrest, epidemic, extreme weather or action by a government authority. Where such an event occurs, we will contact you and agree how to proceed.
27Suspension and termination
We may restrict or withdraw your access to the Website, decline an order or end a participation arrangement where you breach these terms, where there is a safeguarding concern or where we reasonably suspect fraud. Where it is appropriate and lawful to do so, we will tell you why.
28General terms
- Severability. If any provision is found unenforceable, the rest remains in force.
- Waiver. If we do not enforce a term, that is not a waiver of our right to enforce it later.
- Assignment. You may not transfer your rights under these terms without our written consent. We may transfer ours to a successor organization.
- Entire agreement. These terms, together with the Privacy Policy and any written order confirmation, are the whole agreement between us on their subject matter.
- No partnership. Nothing in these terms creates a partnership, agency or employment relationship between you and CYEF.
- Third parties. Only you and CYEF may enforce these terms.
29Governing law and disputes
These terms and any dispute arising from them are governed by the laws of the Republic of Kenya and the courts of Kenya have jurisdiction.
Before going to court, both sides agree to try to resolve the matter in good faith. Raise it with us in writing and we will aim to respond within 14 days. If it cannot be settled that way, the parties may agree to mediation before taking the matter further. Nothing here prevents either party from seeking urgent relief from a court where it is necessary.
30Complaints
If something has gone wrong, tell us. Email info@chipukeezyfoundation.org with "Complaint" in the subject line, setting out what happened and what you would like us to do.
We acknowledge complaints within 5 working days and aim to resolve them within 30 days. Data protection complaints may also be taken to the Office of the Data Protection Commissioner, as explained in our Privacy Policy. Safeguarding concerns are handled through our Safeguarding page and take priority over everything else.
31Changes to these terms
We may update these terms to reflect changes in our work, our services or the law. The "Last updated" date at the top shows the current version. The version in force is the one published when you use the Website or place an order.
Where a change materially affects your rights, we will highlight it on this page. Continuing to use the Website after a change means you accept the updated terms.
