Terms & Conditions.
These terms govern your use of chipukeezyfoundation.org, including donations, merchandise enquiries and program information. By using this website, you agree to these terms.
These Terms & Conditions ("Terms") apply to your use of chipukeezyfoundation.org (the "Website") operated by Chipukeezy Youth Empowerment Foundation ("CYEF," "we," "us," "our"). Please read them alongside our Privacy Policy and Safeguarding statement.
1Acceptance of these terms
By browsing this Website, submitting a form, making a donation or ordering merchandise, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Website and contact us directly using the details in Section 15.
2Who we are
Chipukeezy Youth Empowerment Foundation is a Kenya-based youth empowerment organisation founded in 2017 by Vincent Muasya Mutua, working across Machakos, Nairobi and Mombasa through programs in sport, education, media and community partnerships.
3Use of this website
You may browse this Website and use its forms for legitimate purposes such as learning about CYEF's programs, contacting us, applying to partner or volunteer, donating or enquiring about merchandise. You agree not to:
- Use the Website for any unlawful purpose or in a way that could harm CYEF, program participants or other visitors.
- Attempt to gain unauthorised access to the Website, its data or related systems.
- Submit false information, impersonate another person or organisation or misuse enquiry forms (for example, to contact program participants directly).
- Scrape, copy or republish substantial parts of the Website without permission.
- Upload or transmit malicious code, viruses or disruptive content.
4Intellectual property
Unless otherwise credited, the CYEF name, logo, photography, videos, program descriptions and other content on this Website are the property of CYEF or used with permission and are protected by applicable copyright and trademark law. You may share links to this Website and use low-resolution excerpts for fair, non-commercial commentary or press coverage with attribution. Any other reproduction, redistribution or commercial use requires prior written permission from CYEF, obtained through the contact details in Section 15. Media and partner organisations may request approved press assets directly.
5Donations & payments
- Donations to CYEF are voluntary and, once processed, are generally non-refundable, except where made in error or as required by law; refund requests are reviewed case by case.
- Where online card or M-Pesa STK Push payments are active on the Website, transactions are processed by a third-party payment provider whose own terms and privacy practices also apply to the transaction.
- CYEF makes no representation as to the tax-deductibility of a donation unless expressly confirmed in writing for a specific gift or campaign.
- Supporters can confirm giving instructions, receipts or campaign-specific arrangements through official CYEF contact channels at any time.
6Merchandise orders
The Merchandise page prepares order enquiries for official CYEF items such as the CYEF jersey (currently listed at KES 3,000). Submitting an order enquiry does not guarantee stock availability.
- Sizes, quantities, pricing and payment method are confirmed directly with CYEF before payment is taken.
- Delivery or pickup arrangements are agreed with the buyer once payment is confirmed.
- Exchanges or returns depend on stock availability, item condition and are handled on a case-by-case basis; please raise any issue promptly after receiving your order.
- Bulk or partner orders are handled through separate written confirmation covering prices, timelines and delivery.
7Programs & content accuracy
Program descriptions, campaign needs, impact figures and partner information on this Website are provided for public information and are updated periodically; they are presented in good faith but are not a guarantee of future results, availability or continuity of any specific program. Enquiries about program participation, volunteering or partnership through this Website do not guarantee acceptance or selection; all applications are reviewed by CYEF according to program-specific criteria. Where official documents (such as annual reports) are provided, those documents are authoritative over general website copy in the event of any conflict.
8Safeguarding
Because CYEF works with children and vulnerable youth, all visitors, volunteers, partners, media and vendors are expected to follow CYEF's safeguarding expectations at all times when engaging with our programs or personnel. See our full Safeguarding statement for details and how to raise a concern.
9Third-party links
This Website may link to third-party sites, including social media, payment providers and partner organisations. CYEF is not responsible for the content, accuracy or privacy practices of external sites and inclusion of a link does not imply endorsement.
10Disclaimers
This Website and its content are provided "as is" and "as available." While we take reasonable care to keep information accurate and the Website available, CYEF does not warrant that the Website will be uninterrupted, error-free or free of viruses or that content is complete or current at all times.
11Limitation of liability
To the fullest extent permitted by law, CYEF shall not be liable for any indirect, incidental or consequential loss or damage arising from your use of or inability to use, this Website, including reliance on any information published on it. Nothing in these Terms limits liability that cannot be excluded under Kenyan law.
12Indemnity
You agree to indemnify and hold CYEF, its staff, volunteers and directors harmless from any claim, loss or expense arising from your misuse of the Website or breach of these Terms.
13Governing law
These Terms are governed by the laws of Kenya. Any dispute arising from these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of Kenya.
14Changes to these terms
We may update these Terms from time to time to reflect changes in our operations or legal requirements. The "Last updated" date at the top of this page shows when it was last revised. Continued use of the Website after changes take effect constitutes acceptance of the revised Terms.
